On the 12th August, 2022, Grenadian World Champion Javelin Thrower Anderson Peters and his brother, Kiddon Peters, (“Claimants”) commenced admiralty in rem proceedings against the Motor Vessel “Harbour Master” (“M/V Harbour Master”), a renowned ‘party boat’ in the Eastern Caribbean region, arising out of alleged personal injuries suffered after a scuffle broke out between the Claimants and certain members of the ship’s crew. The Claimants allege that the ship’s crew were the aggressors, while crew maintain that the scuffle began after the Claimants got violent after repeated demands for them to disembark the M/V Harbour Master.
An ex parte Order of Arrest was granted by a Judge of the Supreme Court of Grenada against the M/V Harbour Master on the 12th August, 2022, and the vessel was arrested on that date.
The Owners of the M/V Harbour Master thereafter retained the services of our firm and negotiations began with respect to bail and/or the release of the res with the Claimants’ Attorneys-at-Law in Grenada. Additionally, our firm liaised with the vessel’s Insurers with respect to insurance coverage and the release of the M/V Harbour Master.
After several discussions and exchange of written correspondence, the M/V Harbour Master was released, with the agreement of the Claimants, from judicial arrest on the 7th September, 2022, without the placement of bail and/or security for the release of the vessel. The Owners of the M/V Harbour Master also maintain that the admiralty in rem jurisdiction of the Grenadian Courts was improperly invoked, and have signaled their intention to have the proceedings challenged.
The Owners of the M/V Harbour Master were represented by Nyree Alfonso, Asif Hosein-Shah and Dylan Sylvester. These proceedings are ongoing in the Supreme Court of Grenada and the West Indies Associated States.
