Court orders payment of debt due to various Claimants out of vessel’s judicial sale proceeds

Between 2019 and 2020, several Claimants commenced proceedings against the Owners and/or Parties interested in the Motor Vessel “Atlantic Provider” (“M/V Atlantic Provider”) arising out of substantial debt due to the Claimants respectively arising out of; berthing charges, repairs, crew wages, agency fees and provision of ship stores.

The M/V Atlantic Provider was thereafter sold pursuant to an Order for Judicial Sale made by the Honourable Mr. Justice Kevin Ramcharan. Having acquired judgment in all claims, on the 27th June, 2022, the Honourable Judge ordered the payment of the debts due to the respective Claimants out of the proceeds of sale of the M/V Atlantic Provider.

Nyree Alfonso and Asif Hosein-Shah represented the Claimants in the proceedings.
